Non abbiamo designato un Responsabile della protezione dei dati (DPO), perché non ricorrono i casi di designazione obbligatoria previsti dall’art. 37 del GDPR.

2Quali dati trattiamo, perché e per quanto tempoWhat data we process, why and for how long

Questa informativa riguarda il sito tomorrowvisionmedia.it; non riguarda i siti di terzi raggiungibili tramite link (vedi il punto 9). Trattiamo due categorie di dati personali: i dati di navigazione e i messaggi che ci invii. Il sito memorizza inoltre nel tuo browser la lingua che scegli, un’informazione che non ci viene mai trasmessa (ultima scheda).

Dati di navigazione

Quali dati
Indirizzo IP, data e ora della richiesta, pagina o file richiesto, esito della richiesta, tipo di browser e di sistema operativo, sito di provenienza. Li registrano automaticamente i server su cui è ospitato il sito.
Perché
Far funzionare il sito, garantirne la sicurezza e prevenire abusi. Non li usiamo per identificarti né per profilarti; possono servire a individuare i responsabili solo in caso di attacchi o abusi ai danni del sito, anche su richiesta delle autorità.
Base giuridica
Il nostro legittimo interesse a mantenere il sito sicuro e funzionante (art. 6, par. 1, lett. f, GDPR).
Per quanto tempo

Rispondere alla tua richiesta e, se lo chiedi, preparare una proposta o un preventivo.
Base giuridica
Se ci chiedi una proposta o un preventivo per un contratto di cui sarai tu la parte (per esempio come libero professionista o ditta individuale): misure precontrattuali adottate su tua richiesta (art. 6, par. 1, lett. b, GDPR). In tutti gli altri casi, compreso quando ci scrivi per conto di un’azienda o di un ente: il nostro legittimo interesse a rispondere e a gestire i rapporti con clienti e partner (art. 6, par. 1, lett. f, GDPR).
Per quanto tempo
Il tempo necessario a gestire la richiesta e, se non nasce un rapporto contrattuale, non oltre 24 mesi dall’ultimo scambio. Se il rapporto nasce, i dati restano per la sua durata e per i termini previsti dalla legge (per esempio quelli contabili e fiscali), come spiegheremo nell’informativa che ti daremo in quel momento.

Finché non cancelli i dati del sito dal browser; alcuni browser possono cancellarli da soli dopo un periodo senza visite.

This notice covers the tomorrowvisionmedia.it website; it does not cover third-party sites reached through links (see section 9). We process two categories of personal data: browsing data and the messages you send us. The site also stores in your browser the language you choose, information that is never sent to us (last box).

Browsing data

What data
IP address, date and time of the request, page or file requested, outcome of the request, browser and operating system type, referring site. The servers hosting the site record them automatically.
Why
Keeping the site running and secure, and preventing abuse. We do not use them to identify or profile you; they may be used to identify those responsible only in the event of attacks on or abuse of the site, including at the request of the authorities.
Legal basis
Our legitimate interest in keeping the site secure and working (Art. 6(1)(f) GDPR).
How long
We do not export or copy these data elsewhere, and we do not combine them with other data. The hosting provider keeps them for as long as strictly necessary for these purposes, under its own retention rules.

What data
Name, email address, text of the message and any attachments or other information you choose to send us by writing to info@tomorrowvisionmedia.it.
Why
Replying to your request and, if you ask, preparing a proposal or a quote.
Legal basis
If you ask us for a proposal or quote for a contract to which you will be a party (for example as a freelancer or sole trader): steps taken at your request prior to entering into a contract (Art. 6(1)(b) GDPR). In all other cases, including when you write on behalf of a company or organisation: our legitimate interest in replying and in managing relations with clients and partners (Art. 6(1)(f) GDPR).
How long
As long as needed to handle the request and, if no contract follows, no more than 24 months after the last exchange. If a contract follows, the data are kept for its duration and for the periods required by law (for example accounting and tax rules), under the notice we will give you then.

Language preference

What data
The language chosen with the IT/EN switch, stored in your browser. It contains no personal data and is not sent to our servers.
Why
Showing you the site in your chosen language when you come back.
Applicable rule
This is not processing of personal data by us. Storing it on your device is allowed without consent because it is needed to provide the function you asked for (Art. 122(1) of the Italian Privacy Code, Legislative Decree 196/2003). Details are in the Cookie Policy.
How long
Until you clear the site’s data from your browser; some browsers may delete it on their own after a period without visits.

  • il personale e i collaboratori di Tomorrow Vision Media autorizzati e vincolati alla riservatezza;
  • Vercel Inc. (440 N Barranca Ave #4133, Covina, CA 91723, Stati Uniti), che ospita il sito e ne distribuisce i contenuti. Per questo servizio agisce come nostro responsabile del trattamento (art. 28 GDPR), alle condizioni del suo Data Processing Addendum; per i dati tecnici generati dall’uso della sua piattaforma, che tratta per finalità proprie come la sicurezza e il funzionamento del servizio, agisce invece come titolare autonomo, secondo la sua informativa sulla privacy;
  • Aruba S.p.A., che fornisce il servizio di posta elettronica con cui riceviamo i tuoi messaggi e agisce come nostro responsabile del trattamento;
  • consulenti e professionisti che ci assistono (per esempio in materia legale, contabile e fiscale), vincolati al segreto professionale o alla riservatezza;
  • le autorità competenti, quando la legge lo richiede.

We do not make your data public, and we do not sell them or pass them on to third parties for their own purposes. They may be processed by:

  • authorised staff and collaborators of Tomorrow Vision Media, bound by confidentiality;
  • Vercel Inc. (440 N Barranca Ave #4133, Covina, CA 91723, United States), which hosts the site and delivers its content. For this service it acts as our processor (Art. 28 GDPR) under its Data Processing Addendum; for the technical data generated by the use of its platform, which it processes for its own purposes such as security and service operation, it acts as an independent controller under its privacy notice;
  • Aruba S.p.A., which provides the email service through which we receive your messages and acts as our processor;
  • advisers and professionals who assist us (for example in legal, accounting and tax matters), bound by professional secrecy or confidentiality;
  • the competent authorities, where the law requires it.

5Trasferimenti fuori dallo Spazio economico europeoTransfers outside the European Economic Area

Vercel ha sede negli Stati Uniti e distribuisce i contenuti da una rete di server in più Paesi: i dati di navigazione possono quindi essere trattati anche fuori dallo Spazio economico europeo. Vercel aderisce all’EU-U.S. Data Privacy Framework, per il quale la Commissione europea ha adottato una decisione di adeguatezza (decisione di esecuzione (UE) 2023/1795). Il suo Data Processing Addendum, consultabile su vercel.com/legal/dpa, contiene inoltre le Clausole contrattuali standard approvate dalla Commissione (decisione di esecuzione (UE) 2021/914).

Vercel is based in the United States and delivers content from a network of servers in several countries, so browsing data may also be processed outside the European Economic Area. Vercel participates in the EU-U.S. Data Privacy Framework, for which the European Commission has adopted an adequacy decision (Implementing Decision (EU) 2023/1795). Its Data Processing Addendum, available at vercel.com/legal/dpa, also contains the Standard Contractual Clauses approved by the Commission (Implementing Decision (EU) 2021/914).

7MinoriChildren

Il sito si rivolge a un pubblico adulto: aziende, emittenti, genitori e partner. Dino’s Adventures è una serie pensata per i bambini, ma questo sito non chiede dati ai bambini e non offre loro funzioni interattive: come per ogni visitatore, i server registrano soltanto i dati tecnici di navigazione descritti al punto 2. Gli episodi sono pubblicati sul canale YouTube della serie, dove valgono le regole e l’informativa di YouTube. Se pensi che un minore ci abbia inviato dati personali, scrivici e li cancelleremo, salvo che la legge ci obblighi a conservarli.

The site is aimed at an adult audience: companies, broadcasters, parents and partners. Dino’s Adventures is a series made for children, but this site does not ask children for any data and offers them no interactive features: as for any visitor, the servers record only the technical browsing data described in section 2. The episodes are published on the series’ YouTube channel, which is subject to YouTube’s terms and privacy policy. If you think a minor has sent us personal data, write to us and we will delete them, unless the law requires us to keep them.

8I tuoi dirittiYour rights

Puoi chiederci in qualsiasi momento:

  • l’accesso ai dati che ti riguardano e una loro copia (art. 15);
  • la rettifica dei dati inesatti o incompleti (art. 16);
  • la cancellazione dei dati, nei casi previsti (art. 17);
  • la limitazione del trattamento, nei casi previsti (art. 18);
  • la portabilità dei dati che ci hai fornito, cioè riceverli in un formato strutturato, di uso comune e leggibile da dispositivo automatico, o farli trasmettere a un altro titolare, quando il trattamento si basa sul contratto o sul consenso ed è automatizzato (art. 20).

Diritto di opposizione. Puoi opporti in qualsiasi momento, per motivi connessi alla tua situazione particolare, ai trattamenti basati sul nostro legittimo interesse descritti al punto 2 (art. 21 GDPR). Smetteremo di trattare i dati, salvo che dimostriamo motivi legittimi cogenti che prevalgono sui tuoi interessi o che i dati ci servano per accertare, esercitare o difendere un diritto in sede giudiziaria.

Per esercitare i tuoi diritti scrivi a info@tomorrowvisionmedia.it: ti rispondiamo senza ingiustificato ritardo e comunque entro un mese dalla richiesta; se le richieste sono complesse o numerose, il termine può essere prorogato di due mesi, e in tal caso te lo diciamo entro il primo mese (art. 12 GDPR). Per proteggere i tuoi dati potremmo chiederti di confermare la tua identità.

Se ritieni che il trattamento violi la normativa, hai il diritto di proporre reclamo al Garante per la protezione dei dati personali o all’autorità di controllo dello Stato dell’Unione europea in cui risiedi abitualmente, lavori o si è verificata la presunta violazione (art. 77 GDPR).

You can ask us at any time for:

  • access to the data concerning you and a copy of them (Art. 15);
  • rectification of inaccurate or incomplete data (Art. 16);
  • erasure of the data, in the cases provided for (Art. 17);
  • restriction of processing, in the cases provided for (Art. 18);
  • portability of the data you gave us, that is, receiving them in a structured, commonly used and machine-readable format or having them transmitted to another controller, where the processing is based on contract or consent and is carried out by automated means (Art. 20).

Right to object. You may object at any time, on grounds relating to your particular situation, to the processing based on our legitimate interest described in section 2 (Art. 21 GDPR). We will stop processing the data unless we demonstrate compelling legitimate grounds that override your interests, or need the data to establish, exercise or defend legal claims.

To exercise your rights, write to info@tomorrowvisionmedia.it: we reply without undue delay and in any event within one month of your request; where requests are complex or numerous, this period may be extended by two further months, in which case we will tell you within the first month (Art. 12 GDPR). To protect your data we may ask you to confirm your identity.

If you believe the processing breaches the law, you have the right to lodge a complaint with the Italian Data Protection Authority (Garante per la protezione dei dati personali) or with the supervisory authority of the EU country where you habitually reside, work or where the alleged infringement took place (Art. 77 GDPR).
